Welcome to Kstardolls. This website and online store are operated by k-stardolls Trading Co., Limited ("Kstardolls," "we," "us," or "our"). We provide this website, including all related information, content, features, tools, products, and services (collectively, the "Services"), to you subject to these Terms of Service (the "Terms"). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services or purchase products from us. Please read them carefully because they include important provisions concerning orders, payments, warranties, liability, and dispute resolution.

By visiting, accessing, or using the Services, or by placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.

SECTION 1 — ELIGIBILITY, ACCESS, AND ACCOUNTS

You must be at least the age of majority in your place of residence to make a purchase. If a minor uses the Services, such use must be supervised and authorized by a parent or legal guardian. Products intended for children must be selected, purchased, and supervised by an adult in accordance with the product instructions and applicable age recommendations.

You may be required to provide information such as your email address, billing information, payment details, and shipping address. You represent that the information you provide is accurate, current, and complete and that you have the right to provide it.

If you create an account, you are responsible for safeguarding your login credentials and for activity occurring through your account. You must notify us promptly if you suspect unauthorized access. You may not sell, transfer, assign, or license your account to another person.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display and describe our products accurately. However, colors, textures, proportions, and appearance may vary depending on your device, display settings, lighting, photography, and the handmade or hand-finished nature of certain products.

Reborn dolls and related handmade or hand-finished products may have minor variations in painting, hair placement, skin tone, weight, measurements, clothing, or accessories. Such reasonable variations are not necessarily defects. Product dimensions and weights are approximate unless expressly stated otherwise.

Please read product descriptions, material information, care instructions, safety notices, and age recommendations before purchase and use. Unless expressly described as suitable for bathing or immersion, products should not be submerged in water. Small parts, magnets, accessories, and packaging may present hazards to young children and must be used under appropriate adult supervision.

We may update product descriptions, limit quantities, discontinue products, or restrict sales by person, household, geographic area, or jurisdiction, subject to applicable law. Nothing in these Terms limits rights you may have when a product is faulty, unsafe, materially misdescribed, or otherwise nonconforming under applicable consumer law.

SECTION 3 — ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase. An automated order acknowledgment does not necessarily mean that we have accepted your order. An order is accepted when we confirm acceptance or dispatch the product, depending on the checkout process and applicable law.

We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or description errors, suspected fraud, payment authorization failure, delivery restrictions, or violation of these Terms. If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order using the original payment method, subject to applicable law.

Please check your order carefully before submitting it. Cancellation requests are handled in accordance with our Refund Policy and applicable consumer law. We will use the contact information supplied with the order if we need to contact you.

Unless we expressly agree otherwise, purchases are for personal or household use and not for commercial resale, redistribution, or unauthorized export.

SECTION 4 — PRICES, TAXES, AND PAYMENT

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed at checkout when your order is submitted, subject to correction of obvious errors and applicable law. Unless expressly stated otherwise, prices do not include shipping charges, customs duties, import taxes, brokerage fees, or similar charges.

You are responsible for reviewing the total price and currency shown at checkout. Your bank or payment provider may charge currency conversion or other fees that we do not control.

Payments may be processed through Shopify Payments, PayPal, or other payment methods displayed at checkout. You represent that you are authorized to use the selected payment method and that the billing information you provide is accurate. Payment services may be subject to the payment provider's own terms and privacy policy.

Promotions may be governed by separate conditions. If promotion-specific conditions conflict with these Terms, the promotion-specific conditions apply to that promotion.

SECTION 5 — SHIPPING, DELIVERY, CUSTOMS, AND RISK

Shipping options, estimated delivery periods, and applicable charges will be displayed at checkout or described in our Shipping Policy. Delivery dates are estimates unless we expressly state that a date is guaranteed.

Delays may occur because of customs clearance, carrier disruption, severe weather, public emergencies, incorrect address information, or other circumstances outside our reasonable control. We will provide reasonable assistance where a shipment is delayed or lost.

You are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address, refusal of delivery, or failure to collect a shipment may be charged to you where permitted by law.

International orders may be subject to import duties, taxes, customs charges, or brokerage fees imposed by the destination country. Unless checkout expressly states that these charges are included, you are responsible for them.

Title and risk of loss pass to you when you, or a person identified by you other than the carrier, receives physical possession of the products, except where applicable law provides otherwise or where you independently arrange a carrier not offered by us.

SECTION 6 — RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, exchanges, order cancellations, damaged items, and incorrect items are governed by our Refund Policy, which forms part of these Terms.

Any exclusion or restriction in our Refund Policy does not apply where prohibited by law. Your statutory rights regarding faulty, unsafe, misdescribed, or nonconforming products remain unaffected.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their content, including text, graphics, photographs, videos, logos, product names, designs, page layouts, and software, are owned by or licensed to Kstardolls and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial shopping purposes. Without our prior written permission, you may not copy, reproduce, modify, distribute, sell, license, publish, publicly display, create derivative works from, scrape, or commercially exploit the Services or their content, except where applicable law expressly permits such activity.

Kstardolls names, logos, designs, and slogans are trademarks or trade identifiers of Kstardolls or its licensors. Shopify names and marks belong to Shopify. Other names and marks belong to their respective owners.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment services, integrations, or features supplied by third parties. Third-party services may be governed by their own terms and privacy policies. To the extent permitted by law, we are not responsible for third-party services that we do not own or control.

Your use of an optional third-party tool is at your discretion. We may introduce new tools and features, which will form part of the Services and be subject to these Terms unless separate terms are provided.

SECTION 9 — THIRD-PARTY LINKS

The Services may contain links to third-party websites. We do not control and are not responsible for their content, products, security, availability, or practices. Review the third party's terms and policies before using its website or entering into a transaction. Questions about third-party products or services should be directed to the relevant provider.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Kstardolls is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are made directly from k-stardolls Trading Co., Limited. Shopify is not the seller of our products and is not responsible for our products, order fulfillment, customer service, or any injury, damage, or loss arising from a purchase from us, except to the extent Shopify has an independent legal obligation that cannot be excluded.

SECTION 11 — PRIVACY

Our collection and use of personal information are described in our Privacy Policy. Certain information is also processed by Shopify in accordance with the Shopify Consumer Privacy Policy. By using the Services, you acknowledge that you have had the opportunity to review these policies.

SECTION 12 — REVIEWS, FEEDBACK, AND USER CONTENT

If you submit a review, photograph, comment, suggestion, or other content ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, translate, display, and distribute that User Content for operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy. This license continues for as long as reasonably necessary for those purposes, but it does not transfer ownership of your User Content to us.

You represent that you own or have permission to submit the User Content; that it is accurate where it states facts; that you have disclosed any incentive received; and that it does not violate law, intellectual-property rights, privacy rights, or other rights. Do not submit images or personal information of a child unless you are the parent or legal guardian or have appropriate authorization.

We may moderate or remove User Content that violates these Terms or applicable law. We are not required to publish, maintain, compensate, or respond to submitted User Content.

SECTION 13 — ERRORS AND AVAILABILITY

Information on the Services may occasionally contain errors or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability. We may correct information and update the Services. If an error materially affects an accepted order, we will contact you and provide any remedy required by applicable law, which may include cancellation and a refund.

SECTION 14 — PROHIBITED USES

You may use the Services only for lawful purposes. You must not:

• violate applicable law or the rights of another person;
• submit false, misleading, fraudulent, defamatory, abusive, obscene, or unlawful material;
• impersonate another person or misrepresent your identity or authority;

• send spam, phishing messages, or unauthorized advertising;

We may restrict or suspend access where we reasonably believe these Terms have been violated.

SECTION 15 — TERMINATION

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary to protect the Services, comply with law, prevent fraud or abuse, or respond to a material breach of these Terms. Termination does not affect rights, payment obligations, or liabilities accrued before termination.

Provisions that by their nature should survive termination will remain effective, including provisions relating to intellectual property, User Content, disclaimers, liability, indemnification, governing law, and disputes.

SECTION 16 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

To the fullest extent permitted by law, we disclaim implied warranties relating to the Services and products, including merchantability, satisfactory quality, fitness for a particular purpose, durability, title, and non-infringement. This disclaimer does not exclude any warranty, guarantee, or statutory consumer right that cannot lawfully be excluded or limited.

SECTION 17 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such exclusion is prohibited, or breach of mandatory consumer rights.

Subject to the preceding paragraph and to the fullest extent permitted by law, Kstardolls and its directors, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses, or for lost profits, revenue, savings, business opportunities, goodwill, or data arising from use of the Services or products.

For losses arising from a particular order, and to the fullest extent permitted by law, our aggregate liability will not exceed the amount you paid to us for that order. This limitation does not apply where prohibited by law.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Kstardolls and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable legal costs arising from your unlawful use of the Services, material breach of these Terms, or violation of another person's rights. This provision does not require a consumer to indemnify us for our own negligence, breach, or unlawful conduct.

SECTION 19 — FORCE MAJEURE

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics, war, civil unrest, government action, labor disputes, transportation disruption, customs delays, telecommunications failure, or interruption of essential suppliers. This section does not remove rights or remedies that applicable consumer law provides.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

A failure or delay in enforcing a provision is not a waiver of that provision. These Terms and the policies incorporated by reference constitute the agreement between you and us concerning use of the Services and supersede prior communications concerning that subject. Nothing in this section excludes representations or rights that cannot legally be excluded.

SECTION 22 — ASSIGNMENT

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, reorganization, sale of business, or transfer to an affiliate, provided that the assignment does not reduce mandatory consumer protections. Any assignment will be subject to applicable law.

SECTION 23 — GOVERNING LAW AND DISPUTES

These Terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. The courts of Hong Kong will have non-exclusive jurisdiction.

If you are a consumer, this choice of law and jurisdiction does not deprive you of mandatory protections or the right to bring proceedings in a court available to you under the laws of your country or place of residence. Before starting formal proceedings, we encourage you to contact us so we can attempt to resolve the matter.

SECTION 24 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the Services, our business practices, or legal requirements. The current version will be posted on this page with an updated revision date. Where required by law, we will provide additional notice of material changes. Changes will not retroactively alter an accepted order unless permitted by law or agreed with you.
